General Provisions

North Carolina tipping is governed by sections of the North Carolina Wage and Hour Act (N.C. Gen. Stat. § 95-25) and administrative law (13 NCAC 12) that specifically addresses tips. North Carolina follows federal law, including the Fair Labor Standards Act (FLSA), which defines tipped employees as individuals engaged in occupations in which they customarily and regularly receive more than $30 a month in tips.
